EQUIPMENT RENTAL AGREEMENT, LIABILITY WAIVER & INDEMNIFICATION

This Agreement is made between Prestige Party Rental LLC (“Lessor”) and the undersigned customer (“Lessee”).

3. DELIVERY, SETUP & SITE REQUIREMENTS

Lessee agrees to provide:

• A safe, flat, and accessible setup area

• Adequate access (minimum 3–4 ft width)

• Clear space free of hazards, debris, or obstructions

Lessor reserves the right to refuse setup if conditions are unsafe.

4. EQUIPMENT USE & RESPONSIBILITY

Lessee agrees:

• Equipment will be used only for its intended purpose

• Equipment will remain at the delivery location

• Equipment will not be moved, altered, or tampered with

Lessee assumes full responsibility for all rented equipment during the rental period.

5. SUPERVISION (IF APPLICABLE)

For equipment involving active use (including inflatables):

• A responsible adult (18+) must supervise at all times

• Safety rules must be enforced

6. SAFETY RULES (INFLATABLES ONLY)

If inflatable equipment is rented, Lessee agrees to enforce:

• No flips, rough play, or climbing

• No shoes, food, drinks, or sharp objects

• No overcrowding

• No use while wet

7. POWER REQUIREMENTS (IF APPLICABLE)

Certain equipment (such as inflatables) requires:

• Standard 110V electrical outlet

• Continuous power during use

Loss of power may create safety risks for which Lessee is responsible.

8. WEATHER POLICY

• Equipment should not be used in unsafe weather conditions

• Lessor reserves the right to cancel or reschedule due to severe weather

No refunds will be issued unless cancellation is made by Lessor.

9. DAMAGE, LOSS & CLEANING

Lessee is fully responsible for all rented equipment from the time of delivery until pickup.

Lessee agrees to pay for any damage, loss, theft, or excessive cleaning required, including but not limited to the following charges:

BASIC REPAIR COSTS (MINIMUM CHARGES)

• Inflatables: $250 minimum repair fee

• Tables: $20 per table

• Chairs: $5 per chair

Note: These are minimum charges. Actual repair costs may exceed these amounts depending on the extent of damage.

FULL REPLACEMENT COSTS

If any equipment is lost, stolen, or damaged beyond repair, Lessee agrees to pay the full replacement value, including:

• Inflatables: Up to $2,000 per unit

• Tables: $50 per table

• Chairs: $10 per chair

Final replacement cost will be determined based on current market value if higher than listed amounts.

CLEANING FEES

Equipment must be returned in the same condition as delivered.

Excessive dirt, mud, stains, food, or debris may result in additional cleaning fees at Lessor’s discretion.

AUTHORIZATION TO CHARGE CARD ON FILE

Lessee authorizes Prestige Party Rental LLC to charge the payment method on file for any damages, replacement costs, cleaning fees, or unpaid balances associated with this rental.

10. LIABILITY WAIVER

Lessee understands that use of rented equipment carries inherent risks.

Lessee agrees to:

• Assume all risks of use

• Release Prestige Party Rental LLC from all liability

This includes injuries, damages, or losses arising from use of equipment.

11. INDEMNIFICATION

Lessee agrees to defend, indemnify, and hold harmless Prestige Party Rental LLC from all claims, damages, and legal costs arising from the rental.

12. DELIVERY CONFIRMATION

Lessee confirms:

• Delivery address is correct

• Setup conditions are safe and accessible

• Equipment is received in good condition

13. REFUSAL / TERMINATION

Lessor reserves the right to:

• Refuse setup for unsafe conditions

• Terminate rental for rule violations

No refunds will be issued in such cases.
